Warranty Disclaimer & Limitation of Liability

All products sold by Ruff N Tuff Tools (“the Company”)—including those purchased through our website, online marketplaces, or any affiliated sales channels—are covered exclusively by the respective manufacturer’s warranty, if one is provided. The Company is not the manufacturer of any products offered for sale and therefore does not provide, extend, or imply any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non‑infringement.

Any claims, service requests, or warranty‑related issues arising from product defects, malfunctions, or performance concerns must be directed to the product’s manufacturer in accordance with their warranty terms. While the Company may assist customers in contacting the appropriate manufacturer, Ruff N Tuff Tools assumes no responsibility for the outcome of any warranty claim and does not guarantee manufacturer performance, coverage, or remedies.

To the fullest extent permitted by law, Ruff N Tuff Tools shall not be liable for any direct, indirect, incidental, consequential, exemplary, punitive, or special damages, including but not limited to personal injury, property damage, loss of use, loss of data, loss of revenue, or any other damages or losses arising out of or related to the purchase, possession, use, misuse, or failure of any product sold by the Company, regardless of the legal theory asserted (contract, tort, strict liability, or otherwise), even if the Company has been advised of the possibility of such damages.

The purchaser acknowledges and agrees that use of any product is at their sole risk, and that the Company shall not be held responsible for any injuries, failures, damages, or losses resulting from product use, installation, modification, or operation.

Indemnification

By purchasing from Ruff N Tuff Tools, the customer agrees to indemnify, defend, and hold harmless the Company and its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to the customer’s purchase, use, or misuse of any product.

Mandatory Arbitration & Waiver of Class Actions

Any dispute, claim, or controversy arising out of or relating to the purchase or use of products sold by Ruff N Tuff Tools, or to these Terms & Conditions, shall be resolved exclusively through binding arbitration administered by a recognized arbitration provider, conducted on an individual basis in the state in which the Company operates. Customers expressly waive the right to file a lawsuit in court, the right to a jury trial, and the right to participate in any class action, class arbitration, or representative proceeding.

The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
